And even if their terms say it, and you agreed with them, they can't make you agree to lose your legal rights. It's the senders responsibility to prove you received the package, if he can't, he has to reimburse you, by either sending the item again, or sending a refund, that's how things go.

You payed for an item including shipping, so you have to receive the item.
If they don't give you back your money, or send you the item, it's considered stealing.

In France, things happen like that :

1- if the parcel is lost (on its way to you, or going back to the sender), it's the responsability of COLISSIMO.FR (= la Poste) and they will reimburse 23€ per Kgs, except if the sender paid for an insurance (different levels of refunds). The sender is the one who complaints near La POSTE.

2- if the parcel went back to the sender (the tracking number has to prove that) ; the responsability of the sender is to refund you 100% or to send you the order again. The buyer is the one who complaints near the Seller.

I just read that in a french consumer defence's magazine and it seems to be logical :|

Well
I know all the personal details of the retailer :?
He gives me all the information before I made the wire transfer.
I have his address, his email, his name and bank account number.
I also contacted his french bank, but the bank didn't care about it.
Also, he never replied my emails anymore, so I guess he is not honest.
its a shit person.

And the french post (colissimo.fr) created a tracking number, offcourse, its: CC567075208FR
but after 40 days, They said that cannot track the parcel.

here is a proof, their last email :

I believe that any product that is not delivered, returns back,
so the colissimo.fr must know where it is

In the email's pic you provide, the french Post (Colissimo) didn't say you that 40 days is too much to track your parcel. They said they can't find any parcel with the tracking number you gave to them 8)
Are you sure of your tracking number CC567075208FR ? if yes, is it possible that Colissimo.fr cleans its database of the unsolved tracking numbers after 40 days ? it would be weird and not fair 8)

hello, the tracking number is correct, i received that number in various emails.
in some emails, colissimo.fr told they can't track the parcel because past more than one month,

the seller, Eloire Jean is a jerk, never replied my emails anymore.

I hope that nobody else gets scammed

that's a pity that this guy doesn't take the time to really complain near Colissimo, the delay is officially one year even if the tracking number disappears from the website after 40 days :roll:

you're right to do a bad advertisement to that company/guy...
