Copenhagen West Region Police have filed charges against a 25-year-old man for possessing a child sex doll. The case is the first of its kind after child sex dolls were criminalized on March 1 this year.
During the investigation of a sex assault case, in which, among other things, a 14-year-old girl was tried blackmailed to send intimate photos of herself, investigators seized a doll's abdomen from the 25-year-old suspected perpetrator.
The doll's abdomen was made for a sexual purpose, and was designed as part of a child's body according to the investigators' assessment.
On March 1, a new provision came into force, according to which anyone who possesses a doll that appears as a child and who is designed for a sexual purpose is punished with a fine or imprisonment for up to one year under section 235a of the Criminal Code.
"We believe that the child doll abdomen is covered by the new child sex doll provision, and therefore we have seized it and filed charges against the owner," said Police Commissioner Tue Lauenblad, head of the investigation department for crime in close relationships at Copenhagen West Region Police.
The doll part was seized in April, and since the investigation is still ongoing, the police commissioner can not release more details from the case. Later, the prosecution must assess whether charges can be brought under the new provision, in which case it will be up to a court to decide the case.
The 25-year-old has not yet taken a position on the charge.
Section 235a of the Penal Code
"Anyone who manufactures or sells or otherwise transfers a doll that appears as a child and that is designed for a sexual purpose is punishable by a fine or imprisonment for up to 2 years.
PCS. 2. Whoever possesses a doll as mentioned in para. 1, shall be punishable by a fine or imprisonment for up to 1 year. "

I doubt that in cases where a normal doll owner has a torso that is 'questionable' would have that kind of problem with authorities.

Unfortunately, law and jurisprudence does not work that way. Either the sex toy is legal or it's not. The case of blackmailing can not be set as a cause of prohibition of the sex toy regardless of the moral compass.

It's not as simple as something being completely legal or illegal. Something being child-like isn't set in stone. There is a matter of interpretation. To enforce the rule to all doll-owners.. they need to be clear on the factors that makes a torso child-like.
There is also a thing called 'good faith'. This will especially be applied to customers buying from TDF certified vendors. Those doll-websites usually have a list of countries where dolls are prohibited and they will also warn you about your purchase being child-like. When said customer did everything in their power to make sure they are not breaking the law.. they'll be fine.
In the worst case, the manufacturers will have to be more carefull.

273A.1 Possession of child like sex dolls etc.
A person commits an offence if:
(a) the person possesses a doll or other object; and
(b) the doll or other object resembles:
(i) a person who is, or appears to be, under 18 years of age; or
(ii) a part of the body of such a person; and
(c) a reasonable person would consider it likely that the doll or other object is intended to be used by a person to simulate sexual intercourse.
Penalty: Imprisonment for 15 years.
