They had pictures of RealDolls on The Dr's. yesterday

The topic was sex robots but they threw a few of the RD website photos. This show has three people. Two men and a woman. Of course the lady was disgusted. The younger Dr. was kind of interested seeing the pictures. Unfortunately I cant remember which model, etc. I could if I looked before writing this. They were good looking RD's. The third Dr., an older Gentleman who is a perv but a respectable one literally yelled out WHOA! I's bet the first thing he did after the show was visit their website.

I would hope Stacy would first send a letter of intent, offering to settle out of Court. Maybe something like:

I'm flattered you chose to use my photography to convey your story, and it really did help you get your point across. Normally I would charge $XXX for work like that. I'm sure it was just an oversight, and you were planning on paying me for my contribution to your show. Remittance may be sent to:

[address]

In case you had no such intent and deliberately stole from me, you will be hearing from my attorneys by XX date if this has still not been paid. Sincerely,

With something like that, of course the most important thing is getting it to the right person.

I'm not a lawyer, so grain of salt and all, but it's not going to hurt for Stacy to have a lawyer send them a letter with a dollar amount attached to it for using her photos. But if they refuse to pay and it would have to go to court, I think one of the things that the defense would look at is if Stacy has aggressively pursued her copyrights in the past. If she hasn't, then they would probably rest on saying "She's not pursued her copyright in these other cases with her photos being posted without her consent on all these other websites, so why should she have a copyright claim here?

Like it or not, that's why sometimes you'll see the "big evil corporations" sending cease and desist letters to like some kid who posted a youtube video that had a copyright song in the background, or used some images of their IP characters or whatever. They are not trying to get money or anything, they just know they need to set a precedent for if they do have to go after a large scale operation that is stealing their IP, that they can show a history of protecting their copyright.

At least that's my limited understanding.

A lot will depend on where they got the pics.
If they took them directly from Stacy's blog that's one thing.

Problem with pics on the net is they are copied and reposted continually.
And if they were using the pics as just a news story random pics and not as offering anything for sale.
Pics can even have the artist name cropped or photo shopped out so there is no clue where the original came from.

Gamesworkshop has notorious copyright lawyers. Maybe you can hire one to win you a case.

Any exposure is good exposure for dolls. Especially since they used Stacy's photos, this part is good.

Now, if a high profile case gets made, Stacy will become famous as knowledge about the existence of dolls proliferates.
